It's essentially what the purpose of a non-derogation clause would be.

Tony Canade, President of Assured Automotive, commented on the Canadian element of the program. “We need a shop accreditation program that is built by Canadians, for Canadians. Our industry is unique in the world.” Michael Macaluso, President and CEO of CARSTAR, also pointed out the distinctiveness of the Canadian marketplace. “We operate with both public and private insurers. We have intense industry consolidation but also a strong and healthy independent repairer constituency.” He went on to note that “no country in the world has demonstrated collision industry partnership like Canada – we should build on that when it comes to shop accreditation.”

In Bell Canada v. Canada (Canadian Radio-television and Telecommunications Commission), [1989] 1 S.C.R. 1722, this Court considered whether the Canadian Radio-television and Telecommunications Commission had the authority to review revenues of Bell Canada during the period when an interim rate schedule approved by the Commission was in place, and whether the Commission had the jurisdiction to make an order compelling Bell Canada to grant a refund by way of a one-time credit to its customers. In concluding that the Commission did indeed have the power to revisit the situation during this period, the nature of an interim order was considered. Despite the fact that the relevant legislation required that both interim and final orders be just and reasonable, the importance of emphasizing the distinct nature of an interim order was recognized. On the facts of that case (at pp. 1755-56):

The distinct nature of Aboriginal poverty poses unique challenges for Aboriginal peoples, and the government of Ontario has developed a number of initiatives that focus on improving the quality of life for Aboriginal Ontarians. These initiatives support the healthy development of Aboriginal children and youth in ways that respect cultural backgrounds and traditions. These initiatives include such programs as the Urban Aboriginal Education Pilot Project, Ontario Aboriginal Community Justice Programs, Community Recreation Activator Pilot Program, and The Chiefs of Ontario First Nations Public Health Project. First Nation communities have also been able to determine their own priorities for poverty alleviation through gaming revenue-sharing agreements. Individual First Nations use their revenue distributions for a variety of initiatives that pertain to community development, health, education, economic development or cultural development. While these programs do much to support Aboriginal Ontarians, the Poverty Reduction Strategy will extend supports in communities with Aboriginal populations under such programs as Parenting and Family Literacy Centres, the Community Hubs Program, the After School Program, and the Youth Opportunities Strategy.
