Geography is important in access, and services need to be planned so that they can be reached by all within an acceptable travelling time, and at an acceptable transport (or other) cost. If it is possible there should not be user fees for these services as they will pose a barrier to seeking health care and gaining access to justice. Services also need to be available 24 hours a day, seven days a week, and survivors should be able to access same-sex health-care providers.

(d) notwithstanding the measure or instrument to which they may be linked, rules of origin should not be used as instruments to pursue trade objectives directly or indirectly. They should not themselves create restrictive, distorting or disruptive effects on international trade. They should not pose unduly strict requirements or require the fulfilment of a certain condition not relating to manufacturing or processing as a prerequisite for the determination of the country of origin. However, costs not directly related to manufacturing or processing may be included for purposes of the application of an ad valorem percentage criterion;

On Tuesday, 17 May 2011, the Supreme Court of Canada was asked to consider whether people with intellectual disabilities should be allowed to testify in court. Specifically, the question before the Court was whether people with intellectual disabilities are required to demonstrate an understanding of the concept of a “promise to tell the truth” in order to be permitted to testify. CCD was granted intervener status in this case. CCD argued that courts should not impose a test to allow people with disabilities to testify that is not imposed on others. Courts should focus scrutiny on the testimony given by individuals not the individuals themselves. Courts do not test non-disabled persons’ ability to tell the truth, it is only biases and myths that suggest persons with disabilities have any less capacity to determine the truth than others. To exclude persons with intellectual disabilities from testifying in court is profoundly discriminatory. Dave Wright acted as CCD’s legal counsel in this case. We await the Supreme Court’s decision.

It should be noted that the model assumes the removal of ‘all current protection and subsidies’. Unfortunately this is far from the reality of what is likely to emerge from the Doha Development Round. In both the USA and the EU it is being made clear that the WTO negotiations should not constrain domestic agricultural policy formulation. In the case of the EU, Commissioner Fischer Boel has made it clear what this means, assuring EU farmers that the commitment to a 70% cut in domestic subsidies leaves untouched the single farm payment scheme, which accounts for the bulk of EU agricultural support. The conclusions of the report need to be seen in this light and the impact of direct aid payments on production levels in the EU even with dramatic price reductions (see accompanying report on the EU rice sector).
