On this point I must observe, with all due respect for the judge who authorized the issuance of the writ of summons, that the difficulty of a question of law does not dispense him from the obligation of deciding it. This obligation is imposed upon him by the explicit words of art. 847 C.P. in conformity with recent authority: (City of Montreal v. Benjamin News[6]). As is apparent in the present case, the suspension of proceedings is not without serious inconvenience; it often frustrates plaintiff’s recourse.

As noted in A-X, 5.1.2, the amount of fee payable is always that applying on the date of payment (see also the transitional provisions in the Administrative Council decisions revising fees). The payer cannot therefore in this respect seek to rely on the ten-day fail-safe arrangement in order to benefit from an old amount, arguing that he gave instructions for payment before the entry into force of the new amount of fee (see J 18/85); Art. 7(3) RFees and Art. 7(4) RFees protects the applicant in the event of late payment from the legal consequences of expiry of the payment period, but not from the obligation to make up any differences resulting from an increase in the amount of fee in the meantime.

So with the greatest of respect for Dr. Shapiro, I think his concern about his duty under the statute is understandable. It's my view, however, that it is not a duty of a kind that pre-empts him from answering the questions that he was asked by this committee at the previous meeting or that he might be asked later today.
