Le jour où il l'a vu, il nous a demandé d'arranger la vente pour lui. Contrairement aux autres cantons, Genève
ne permet pas de procéder
à l'achat avant d'avoir reçu un permis de séjour. Nous avons alors dû compter sur la bonne volonté du vendeur pour garder l'appartement pour notre client - pas une mince affaire sur un marché immobilier aussi sec que Genève.

Mr. H. wanted to buy the very first apartment we showed him in Geneva. He had seen accommodations in other cantons, but although some were rather impressive, he wanted to be in Geneva. The very day he saw it, he asked us to arrange for its purchase. Now you can't buy real estate in Geneva unless you are a resident. And, unlike other cantons, Geneva does not allow notaries to even write purchase agreements before a residence permit has been received. So we had to rely on the developer's good will to keep the apartment for our client - a tall order in such a tight market as Geneva's. We tought that for Mr. H. to take the first appartment he saw was a rash decision and shared our views with him but hey - the client's always right. Nevertheless, we looked for more houses and appartments to show Mr. H. while we waited for the residence permit and kept the other apartment booked.

The European Communities agrees with Brazil that monitoring compliance under Article 21.5 of the DSU should be meaningful and consistent with the DSU's objective of prompt settlement and compliance. The terms of reference of an Article 21.5 panel must be considered to include the "matter" before the original panel, as well as the additional question of whether that "matter" has been properly resolved (existence and consistency of implementation measures). However, Article 21.5 does not allow an examination of claims that could have been – but were not – included in the original panel's terms of reference. Nor could an Article 21.5 review extend to any provision of any covered agreement, subject only to the terms of reference and the scope of the claim brought under Article 21.5. For instance, it would be inappropriate for Brazil to argue, under Article 21.5 of the DSU, that the revised TPC programme was inconsistent with Article 5 of the SCM Agreement.
