Since it would appear that in order to have found a conviction for the alleged contempt there must have been proof of circumstances which were not in "the face of the court" and "the court cannot have so perfect a knowledge, unless by confession of the party or the testimony of others", to use the words of Blackstone in 4 Commentaries on the Laws of England, 18th ed., at p. 286, I am of the opinion that the contempt was not a contempt in "the face of the court" within the meaning of those words as used in s. 9 of the Criminal Code and, therefore, an appeal lay to the Court of Appeal for Ontario as to both conviction and sentence. With respect, therefore, I believe that the Court of Appeal for Ontario should not have quashed the appeal. In doing so, it affirmed a conviction of the appellant for an indictable offence and under the provisions of s. 597(1) of the Criminal Code an appeal lay to this Court on a question of law if leave to appeal is granted by this Court when no judge of the Court of Appeal for Ontario has dissented. Leave to appeal was granted by this Court on March 19, 1970. Application for such leave to appeal had been made pursuant to the provisions of both s. 597 of the Criminal Code

In T 901/95 the board decided that merely claiming that generating equipment was installed into ships at three different shipyards and thus available to the public was not enough to demonstrate its obvious prior use. Shipyards were normally considered restricted areas and thus not open to the general public. This applied all the more to installations built into ships in the yards. Nor could the possibility be excluded that shipyards' business partners might secure their common interests through explicit or tacit secrecy agreements, in the absence of other protection. In the case in point, it was also questionable whether the relevant process steps and the functional arrangement of the switching means were apparent from merely looking at built-in apparatus; nor was it certain when the generating installations had become operational. Both parties dispensed with oral proceedings and no witnesses were heard; the board did not in these circumstances consider the alleged public prior use.

HIV has shown strong epidemic spread among IDUs in the new EU Member States of the Baltic region, following massive epidemics in eastern Europe (EuroHIV, 2004) (see box ‘HIV and AIDS in eastern Europe’). Rates of newly diagnosed cases peaked in Estonia and Latvia in 2001, and in Lithuania in 2002, but more recently rates have fallen dramatically. This pattern is typical of HIV epidemics among IDUs. It arises because the core group of IDUs at highest risk all become infected in a short period of time, following which incidence falls because of a lack of susceptible IDUs and then stabilises at a level that depends on the rate of recruitment of new IDUs at high risk. However, an additional effect of behaviour change cannot be excluded and, if true, this could in part be the result of specific interventions (see ‘Prevention of drug-related infectious diseases’).
