The respondent Board of Governors of South Saskatchewan Hospital Centre was constituted to construct and operate a hospital on behalf of the Government of Saskatchewan. The appellant, an unpaid subcontractor, claimed to be entitled to a charge upon a holdback fund retained by the Board in connection with the project. At the instance of the head contractor acting on behalf of the Board, the appellant executed a waiver of its rights against the land occupied by the hospital centre.
