If I understand correctly--and this is for the clerk to decide--it is a matter of scheduling and not a matter of stating that the person can come or not. In the past, we have always accommodated somebody whose schedule does not permit them to come on that day. Out of these five meetings with all the proposed witnesses, we are going to have a similar issue where somebody is not available on certain days and may not be able to be accommodated.

The budget of 1938 was a turning point in fiscal policy in Canada. For the first time a government had consciously decided to spend money to counteract a low in the business cycle. In addition to the expenditures in the budget the government also offered loans to municipalities for local improvements and passed a National Housing Act to encourage the building of homes. Consistent with this Keynesian approach, the government also reduced some taxes and offered some tax exemptions for private investors. The idea of a static and balanced budget was gone. In its place was a fiscal policy of stimulating economic recovery by government deficits and by direct economic incentives.

In T 1260/04 the statement setting out the grounds of appeal was deemed not to have been received, as it was only filed electronically. However, the appellant had his rights re-established, as the board was satisfied that the failure to comply with the time limit represented an isolated mistake within a satisfactory system for monitoring time limits. The following practice was normally applied in the representative's office: in order to ensure a consistent internal electronic record of documents, all communications were sent to the EPO in electronic form, but a confirmation copy was sent by fax or courier where a paper copy was still required by the EPO. A docketing system existed which ignored the "ten day rule". The statement setting out the grounds of appeal was filed electronically on 7 October 2004. The filing of the written grounds of appeal was docketed for action by the representative in the docketing system before an internal deadline of 8 October 2004. Since the representative was working late, he decided to send the follow-up paper copy at a later date, conscious that the time limit would not expire until 18 October 2004. Due to an oversight in the week that followed, the paper copy was not sent by fax as intended. The board considered this an isolated mistake due to exceptional circumstances in the case.
