Par contre, la Loi sur les langues officielles n'exige pas du tout que des entreprises comme Air Canada mettent à la disposition de leurs clients des formulaires destinés à recevoir des plaintes. We agree that Air Canada is a business that is governed by the federal government. However, the Official Languages Act in no way requires businesses like Air Canada to provide their clients with complaint forms. I would say that our position is that it should be more inclusive. Nowhere does it say that the cards should be addressed to the commissioner. I do not feel that it is in any way an obligation.

Likewise, the EPC does not require, for the admissibility of an opposition, that an argument brought in support of the opposition has to be conclusive in itself for it to be admissible. Considering the evidence is part of the process of ascertaining whether the opposition is well founded in substance. Under Art. 101(1), first sentence, EPC (Art. 101(1) EPC 1973) this can only be done if it has already been determined that the opposition is admissible (see T 234/86, OJ 1989, 79, T 453/87 and T 2/89, OJ 1991, 51). In that connection, false statements in the notice of opposition cannot affect its admissibility. The statements made in the opponent's pleadings need not be true; the opposition division and the patentee simply have to be able to follow them. Either they ascertain that there is an error in the reference, or that the view taken in the opposition is wrong, or that there is no error and the view taken is correct. This is purely a question of the merits of the case (see T 534/98). In T 353/06 the board defferentiated between the corroborative value of the facts and evidence and the failure to indicate such facts and evidence in support of the grounds of opposition. It noted that establishing that the alleged prior use was indeed public, is a matter of proof and has little bearing on the admissibility of the opposition.
