An applicant for or proprietor of a European patent who, in spite of all due care required by the circumstances having been taken, was unable to observe a time limit vis‑à‑vis the European Patent Office shall have his rights re‑established upon request if the non‑observance of this time limit has the direct consequence of causing the refusal of the European patent application or of a request, or the deeming of the application to have been withdrawn, or the revocation of the European patent, or the loss of any other right or means of redress.

If the patent applicant can show that he did not meet a time limit set by the law, by the ordinance or by the Institute for reasons other than his own negligence, he will have his rights re-established upon request. The request must be submitted within two months of the lifting of the hindrance or, at the latest, one year after the expiry of the time limit; simultaneously the omitted act shall be completed. The re-establishment of rights is not possible if the time limits for requesting the re-establishment itself has expired. If the request is accepted, the situation which would have existed had the time limit been respected will be reinstated.
