42 In Toten, it was suggested that the videotape would be useful in circumstances where a child has a memory of events but is unable to articulate them. In my view, this approach is too narrow. It fails to take into account the broader purposes of the legislation. Trial judges do not expect children to be perfectly articulate. They know that the examination‑in‑chief of a child will not precisely match the ideal narrative form of an adult’s testimony. Indeed, the trial judge has the discretion to permit counsel to use leading questions on examination‑in‑chief in order to get the child’s evidence before the trier of fact. Children are vulnerable victims and for a number of reasons their testimonial capacities may range from a complete inability to articulate recalled events to an ability to recount some but not all of the events. In any of these circumstances, the admission of a videotaped statement would assist a court in arriving at the truth. It would be inappropriate to construe the section as one which only addresses the “inarticulate complainant”.

The reasons behind the ICRC’s testimony policy are well understood in the field. The ICTY Decision aptly summarizes the issue. Prior to the Court’s ruling that the ICRC’s right to absolute confidentiality must be respected in all cases, the Prosecutor sought to introduce testimony from a former ICRC employee. The Prosecutor argued that the decision to either uphold or reject ICRC confidentiality should be made by the Court, on a case-by-case basis. It was claimed that because disclosure would be required only in “the rare case”, the ICRC’s interest would be adequately protected by a balancing test in which the Court would weigh the im portance of the evidence in question against the confidentiality interest of the ICRC.

That being said, Chair, I despair at this committee's ability to deal with this kind of issue. We will remember our attempt to get to the bottom of the political interference in access to information requests, and our attempt to bring staff people to this committee to testify about their involvement in it, and how that ended in miserable failure; how we had to subpoena staff people to attend because, I suspect, somebody had told them not to come and they chose not to come. The government took the position that they shouldn't testify and that ministers should testify in their place, and we had a circus in this committee. The committee was not able to do its work, was not able to get to the bottom of it, and ultimately the committee decided to put that question right off its agenda without making a report and without drawing conclusions.

When you call a witness by way of a subpoena, you have to pay him or her a certain amount of money to cover the costs of coming to the hearing (such as the costs of traveling and staying in a hotel). Witnesses who appear before the Tribunal are entitled to the same fees and allowances as witnesses summoned before the Federal Court.
