The problem was compounded by another change in law in 2001, when the Marine Liability Act not necessarily prohibited but invalidated the use of waivers of liability. The waivers were a very common practice of adventure tourism operators, who have their clients, the users, sign a waiver of liability because of the nature of the risk being different from that in typical or common transportation.
