“The translator, like the witness called to trial, should be compelled to raise his hand and swear to tell the truth and nothing but the truth.”

46               The same applies to the interest of protecting the accused's right to a fair trial.  It may be seen as unfair to tender against an accused as substantive evidence a statement which the state obtained from him in violation of his Charter rights.  However, where the accused chooses to take the stand and place his credibility in issue, vouching to the jury that what he is telling them is the whole truth and nothing but the truth, it is more difficult to say that it is unfair to permit the Crown to cross-examine him on his prior inconsistent statement and to put to him the vital question of which version is true.  These are important considerations which must be weighed against any unfairness arising from the way the statement was taken, if the judge is to properly determine whether admission of the statement would bring the administration of justice into disrepute.

Last Tuesday German comedian Hape Kerkeling playing his fictional character Horst Schlämmer held his first press conference as leader of the Horst Schlämmer Party (HSP) at Berlin's Ritz Carlton hotel. Kerkeling was promoting his still to be completed film Isch Kandidiere! (I'm running for election). The daily Le Quotidien comments: "Exaggeration is allowed in art, but are the statements of Horst Schlämmer & Co really that exaggerated? 'We will get rid of nuclear power. Yes. We will withdraw from the nuclear energy withdrawal programme'. … One can safely say that (serious) politicians are not too keen about such jokes. After all, their entire careers are somehow like comedies. … The Horst Schlämmer character doesn't take the political press seriously either. … Reality and comedy often surpass fiction. … In Germany Horst Schlämmer tells the truth, the whole truth, and nothing but the truth - and he does it before the elections: 'I am incapable of creating four million jobs'."

The Licence Appeal Tribunal is adjusting one part of its procedure for witnesses at an oral hearing before the Tribunal. Before testifying, witnesses will no longer be asked to choose between affirming or swearing an oath with a holy book. The common practice for many tribunals now is that a witness will be asked to simply affirm – for example, “Do you solemnly promise to tell the truth, the whole truth and nothing but the truth? And do you understand that it is against the law to break this promise?”  This affirmation has the same effect as an oath. If a witness still wishes to swear an oath, they will need to bring their own holy book do so.
