Some people may be incapable of exercising autonomy because of immaturity, illness or certain mental health issues. While autonomy may be considered a necessary condition for participation in research, involving those who lack capacity can be valuable, just and even necessary. For those potential research participants, additional measures are needed to protect their interests and to ensure that their wishes (to the extent that these are known), are respected. These measures will generally include seeking consent from an authorized third party who is entrusted to make decisions on behalf of the prospective participant, based on knowledge of that person and their wishes or, if such wishes are unknown, consideration of their welfare. Even when the requirements of free and informed consent cannot be met, respect for persons requires involving the vulnerable person in decision-making where possible. This may include asking about their feelings regarding participation and/or for their assent. Where it is foreseeable that a participant may lose capacity during a research project, such as when studying dementia, it may be appropriate to ask research participants to express their preferences and ensure that they have authorized a trusted person to make decisions on their behalf should they lose the capacity to provide ongoing consent. (See Article 3.11 for guidance on research directives for individuals who lack capacity).

A number of States pointed out that a 10-year fixed period for the clearance of minefields was unrealistic. In addition, at the Brussels Conference the United Kingdom, referring to the problems of clearing “undetectable” plastic mines in the Falkland Islands, proposed that an exception be made in the case of land of marginal economic value where the risk to the civilian population was minimal. The ICRC, however, asked States not to extend the time period and reminded them that the recently adopted obligation in Protocol II as amended to clear mines at the end of ho stilities should not be weakened. The ICRC insisted, as did a number of others, that an open-ended commitment to clear all anti-personnel mines “as soon as possible” was inadequate, as it risked detracting from some of the undoubted urgency that would be contained in a specified time-period. The shortest possible time frame was desirable from a humanitarian point of view; on the other hand, a number of countries were so severely contaminated by mines t hat too short a period would be unrealistic and might deter their adherence to the treaty.

For example, an app that affects the programming of a drug infusion pump could lead to a drug overdose if it is inaccurate. An app that incorrectly measures blood oxygen levels in a patient with chronic lung disease could delay lifesaving diagnosis and treatment. Mobile healthcare apps can pose the same risks of failure as medical devices, including faulty design, poor manufacturing quality and user error. Despite the potential concerns associated with their use, the current regulatory requirements for these programs are complex.2 Not all healthcare apps are approved for use by Health Canada, and there is no requirement to clearly identify apps that have received such approval.
