Adolf Vaags, originally a farmer in Manitoba, learned this lesson from his father when he was a young boy. When Vaags began his own family farm, he followed his father’s advice and ensured that his runoff ditches were properly maintained to secure a successful crop. But Vaags saw a problem. Rotary ditchers would make barrel cuts that left the ground’s surface filled with ruts, making water runoff less efficient. The alternative, a scraper, could evenly cut the ground but was much more labour intensive and far slower than a rotary ditcher.

The launch of an edible oil and animal feed project in Rwanda, as a result of collaboration between the Tanzanian edible oil processing company Mt Meru Group and the Clinton Foundation, is set to see the contracting of ‘an estimated 30,000 local farmers to grow soybeans’. The processing company, Mt Meru Soyco, in association with the Alliance for a Green Revolution in Africa, will provide improved inputs to 20,000 smallholder farmers across Rwanda over the next 3 years, to complement production from its own commercial soy farm. The plant is scheduled to have a ‘crushing capacity of 45,000 tons of oil seeds per annum’, with full capacity being attained in 5 years. According to Mt Meru Soyco, ‘the Project aims to make Rwanda a self- sufficient nation in terms of its consumption of quality edible oil.’

Most alpine farming land in the canton of Obwalden is owned by alpine cooperatives and corporations. These centuries-old organisations are responsible for managing and maintaining pastureland. They decide who can use which pastures and stipulate the conditions and duration of that entitlement. In five of the seven municipalities (Giswil, Kerns, Lungern, Sachseln and Sarnen), individual alpine pastures are allocated – where demand is greater than supply – by drawing lots. In Kerns, for example, eight different cooperatives and corporations share out a total of 4,653 hectares of pastureland, which according to current alpine law can be farmed by the same person for twelve years. The members of the cooperatives and corporations meet in a large restaurant dining room or even at a multi-purpose leisure centre to draw the lots. The procedure varies from community to community – in Lungern it consists of rolling dice, while in Kerns balls are drawn from a butter churn. The draw decides whether it’s all or nothing, whether a farmer gets fertile or non-fertile pastures – in short, it determines the economic prospects of the members’ own farms. At the last draw in Kerns in 2008, more than half of the applicants went away with nothing. As a result, they were forced to make other arrangements for their animals during the summer grazing season, such as purchasing summer grazing rights on someone else’s pastures.

PBRs are sometimes referred to as sui generis rights – meaning that they are “of themselves” – i.e. they stand alone. In 1961, the International Union for the Protection of New Varieties of Plants (UPOV) provided the first international PBR Act – the UPOV Convention which mandated member countries to develop national legislation in line with this Act. The UPOV Convention has been reviewed and changed three times, and the last version, stemming from 1991 (http://www.upov.int/en/publications/conventions/1991/act1991.htm), provides the strongest protection for plant breeders, granting the holder the exclusive right to reproduce and market the protected variety. However, there are two exceptions: the breeders’ exemption and the farmers’ privilege. The breeders’ exemption allows other breeders (including farmers) to use a protected variety in his/her own breeding activities. The farmers’ privilege allows farmers to use the product of the harvest of a protected variety for reproduction purposes on his/her own holding. UPOV 1991 narrowed both the farmers’ privilege and the breeders’ exemption (through the introduction of the concept of essentially derived varieties), and this led to a shift in the level of protection towards that offered by patents.
