The dispatch states that every inhabitant should have a phone line if they so wish; mobile network coverage is close to 100% and ADSL is available to 98% of Swiss households. Since market liberalisation, the range of services has increased dramatically while prices have fallen. This shows that the telecommunications market is working. For the individual cases where services of this nature cannot be provided economically, lawmakers have defined basic services. These guarantee that basic provision of services will be available in high quality and at uniform prices throughout the country. The Confederation has effective instruments at its disposal to implement compulsory basic service provision in the unlikely event that this should prove necessary. Even Switzerland's security policy interests are guaranteed by this proposal as even if Swisscom is sold to a foreign company, the infrastructure (cables and exchanges) remains in Switzerland and can be requisitioned if necessary.

Schon allein die Tatsache, dass Daten aus einer staatlichen Datenbank regelmässig und in beträchtlichem Umfang auch an Private weitergegeben werden, ist nicht unproblematisch. Deshalb hat der Gesetzgeber vorgesehen, dass der Bundesrat regeln soll, „wie die Daten durch die Empfänger und durch Dritte bearbeitet werden“ (Art. 24a Abs. 8 BWIS).

The second point which raises a data protection issue has to do with the lack of clarity of the provisions that regulate the transfer of data to private individuals (e.g. operators of sports stadia), and this also includes the actual processing of the data. The very fact that data from a national database are transferred on a regular basis, and in large quantities, to private individuals is not without its problems. That is the reason why the legislator insisted that the Federal Council establish the principles applicable to the processing of data by private individuals and third parties (Art. 24 a, para. 8 BWIS). This legal requirement, however, is not fulfilled by the ordinance. Instead of which, the standard has actually been set lower. Art. 21 k of the ordinance says that the Service for Analysis and Prevention (DAP – the Swiss domestic intelligence agency) is responsible for regulating the use and processing of data by the organisers of sports events. Unfortunately, the regulations in question do not lay down any rules. On the contrary, Art. 27, para. 3 says that the DAP will work “in close cooperation with the sports organisers and adopt guidelines specifying the conditions under which data may be transferred by sports organisers”. This provision lends itself to criticism because authority is delegated from one body to another without this achieving any benefits in terms of clarity. On the contrary, it creates greater uncertainty because it specifically mentions the transfer of data by sports organisers. So far it is difficult to imagine how and when these issues are likely to be resolved.
