The Federal Council therefore decided on 25 March 2009 that the geographical origin criteria under trade mark law and the obligatory declarations under foodstuffs law will both continue to be applicable in parallel to one another. What does this mean in practice, however? Geographical indications law regulates which geographical designations of origin (e.g. the Swiss cross or the label "Swiss made") may be freely affixed to products for the purposes of advertising. Foodstuffs law requires the mandatory provision of information concerning the country of production and a product's raw materials for health policy reasons. Under current law, both sets of regulations must be adhered to for food products. Nothing should change with regard to this under the revised geographical origin regulations, as their aim is to prevent using correct declarations imposed by foodstuffs law to label a product for promotion purposes when the product does not fulfil the strict criteria for using the ‘Swiss product’ label. In this way, consumers are assured that when they buy a food product with the label "Switzerland" affixed to it, then it genuinely is a Swiss product.
