Sind die Anmeldungsunterlagen im Hinblick auf Art. 84 und Art. 69 EPÜ 1973 vor der Erteilung an geänderte Ansprüche angepasst worden und wurde dabei ein Teil des ursprünglich offenbarten Gegenstands gestrichen, um Übereinstimmungsmängel in der Patentschrift zu vermeiden, so kann der aus diesem Grund gestrichene Gegenstand in der Regel weder erneut in die Patentschrift noch in die Ansprüche in der erteilten Fassung aufgenommen werden, ohne dass ein Verstoß gegen Art. 123 (3) EPÜ 1973 vorliegt.

The validity of the European patent is 20 years maximum, upon condition however that the annual maintenance fees are paid each year on the anniversary of the filing date. These fees are due at the EPO before grant, and at the different national offices of the designated states after grant. It is possible to pursue or to abandon the patent separately in the different states and the European patent can also be invalidated separately in each state by the national courts.

One of these changes regards the future – electronically provided – publication of Austrian patent applications after 18 months from the filing date, or priority date, respectively, with an earlier publication also being possible upon request. What will be published is the specification, the patent claims, the drawings and the abstract as originally filed, as well as – if completed in time – a search report and, furthermore, if amended patent claims have been filed in time before the technical preparations for the publication have been completed, also amended patent claims filed last. The published application will entail a temporary protection for the applicant against unauthorized users of the subject matter of the application, such protection, however, merely comprising a claim to an adequate compensation; such claim to compensation can be asserted up to one year after a patent has been granted on the respective application.

Außerdem plädiert Beckstein für eine Regelanfrage beim Verfassungsschutz, die vor der Erteilung einer Aufenthaltsgenehmigung verpflichtend durchgeführt werden soll.
