Në periudhën 11 janar 1946 –12 dhjetor 1990, gjatë të cilës Shqipëria përjetoi diktaturën komuniste, funksionet e Kryetarit të Shtetit u kryen nga Omer Nishani (10 janar 1946 – 1 gusht 1953), Haxhi Lleshi (1 gusht 1953 – 22 nëntor 1982) dhe Ramiz Alia (22 nëntor 1982 – 22 shkurt 1991). Më 22 shkurt 1991 u krijua Këshilli Presidencial i drejtuar nga Ramiz Alia, i cili i ushtroi funksionet deri më 30 prill 1991.

The end of the Second World War and the liberation of Albania that took place in 1944 were followed by the holding of the first parliamentary elections in December of 1945 and also by the transformation of the Head of State’s function into a collegial body – the Presidium of the National Assembly. From January 11th, 1946 until December 12th, 1990 – a period when Albania experienced the communist dictatorship, – the functions of the Head of State were carried out by Omer Nishani (January 10th, 1946 – August 1st, 1953), by Haxhi Lleshi (August 1st, 1953 – November 22nd, 1982) and by Ramiz Alia (November 22nd, 1982 – February 22nd, 1991). The Presidential Council, headed by Ramiz Alia was founded on February 22nd, 1991 and it lasted until April 30th, 1991.

The very first government headed by Ismail Qemali who also enjoyed the competences of the head of State was created in 1912. On February 6th, 1914, Prince Wilhelm Wied was appointed as Head of State by the Ambassadors’ Conference. From September 1914 until January 1920 Albania was transformed into a battle field and experienced the change of a number of governments, where the post of the Head of State was played by different governments – regencies. On January 8th, 1920 the Lushnja Congress elected the High Council composed by four members, one of whom would exercise the functions of the Head of State by introducing and bringing back the parliamentarian way of governance. In 1924, Fan Noli was elected as head of government while exercising at the same time the functions of the head of State. After the frequent changes in governance, the National Assembly approved and passed the republican form of regime on January 25th, 1925 and elected Ahmet Zogu as the President of Republic. Albania was proclaimed a Monarchy and Ahmet Zogu was crowned the King of Albanians on September 28th, 1928. After Albania was occupied by Italy in April of 1939 and the unification of the two countries, Victor Emmanuelle III became the King of Albania. During 1943-1944 the regencies’ governance was introduced once again under the German occupation.

Presidenti Nishani: Natyrisht ka pasur, ka një Action Plan, plan veprimi i cili natyrisht, dhe për pjesën e gjyqësorit, vetëm disa ditë më përpara kishim dy arritje shumë të rëndësishme. Unë e vlerësova shumë Memorandumin e Mirëkuptimit që u arrit midis Ministrisë së Drejtësisë dhe Këshillit të Lartë të Drejtësisë në çështjen e inspektimeve, por mbi të gjitha, vlerësova shumë miratimin që u bë nga Këshilli i Lartë i Drejtësisë i kritereve për transferimin e gjyqtarëve nga njëra gjykatë në gjykatën tjetër, në mënyrë të tillë që gjatë procesit të transferimit, gjyqtarët jo vetëm të mos e ndiejnë veten të kërcënuar nga askush në këto procese, por çdo veprim të bëhet vetëm mbi bazën e këtyre kritereve që tashmë u draftuan me asistencën e Misionit EURALIUS, por tashmë u miratuan dhe janë pranuar në mënyrë pozitive nga i gjithë komuniteti i gjyqtarëve.

President Nishani: Of course there are, there is an Action Plan, plan the implementation of which, regarding the judiciary, only a few days ago had very important achievements. I esteemed the Understanding Memorandum that was achieved between the Ministry of Justice and the High Council of Justice on the inspection cases, but above all, I esteemed the approval that was done by the High Council of Justice regarding the judges transfer  from one court to another, so that during the transfer the judges won’t fear threatened on this processes, and every  action will be based on these criteria that now are drafted with the assistance of the  EURALIUS mission, now they are passed and they were accepted by the whole judge body. In conclusion we can say, that if we can make it to consolidate transparent and standards procedures, these compound the greatest achievements that can provide an individual, be him the President of the Republic.

President Nishani: All deeds should be judged on the constitutional and legitimacy bases. The best guarantee aren’t individuals, our guarantee are procedures which should be consolidated according to the European standards. These are exactly the guarantees that be granted only by the President of the Republic, whoever He is, but these should come exactly by the procedures we have. And we should consolidate procedures based on the standards that today are applied by the member countries of the European Union. And regarding the case of the promotion for example, of the judges that you mentioned in your very fair question, we should be oriented on the evaluation and promotion of the carrier, which is not done on the  based on the President’s of the Republic  sub conscience, or on the sub conscience on the member of the High Council of Justice, or on other different lobbies that can be  made toward the members of the High Council of Justice, but only based on practice, criteria, and standards systems which will be made public and transparent. And the High Council of Justice including the President of the Republic will make decisions based on this procedure nowadays made public. This is the main engagement that we have in this field.

Presidenti i Republikës ka një mundësi shumë të madhe për shkak edhe të pozicionit të tij dhe si kreu i Këshillit të Lartë të Drejtësisë dhe Këshilli i Lartë i Drejtësisë në bazë të kërkesës që unë u kam adresuar të gjitha anëtarëve të Këshillit do të profilizojë aktivitetin e tij në dy shtylla kryesore: së pari, në qenien e një enti grant për lirinë dhe pavarësinë e gjyqtarëve, në mënyrë të tillë që ata të përmbushin funksionet e tyre tërësisht të mbrojtur nga çdo kërcënim apo shantazh që mund t’u vijë atyre për shkak të ushtrimit të detyrës, dhe Këshilli i Lartë i Drejtësisë, dhe Presidenti i Republikës, ka detyrën të konsolidohen si mbrojtës të pavarësisë së gjyqtarëve në ushtrimin e detyrës së tyre, dhe nga ana tjetër, në përmbushje të interesit të qytetarëve shqiptarë, si një ent i cili do të hetojë dhe godasë çdo fenomen korruptimi që lidhet me mungesën e dhënies së drejtësisë.

President Nishani: I am engaged in front of the Albanian public opinion, but also in front of the Albanian institutions that the President’s priority is the judicial reform. The President of the republic has a great chance because of His position as Head of the High Council of Justice based on the demand I have addressed to all member of the Council I will profile their activity in two main pillars: first being a body  for  freedom and judges independence, so they can fulfill their duties  totally protected from every threat they might have because of their duty, and the High Council of Justice and the President of the Republic have the duty to be consolidated as protectors of the judges independence during the practicing  of their duty and on the other side in compliance with the Albanian citizens interest, it will be a body which will enquire and fight every corruption phenomena that is related to justice. These two are the main challenges of the High Council of Justice, but also to the President of the Republic as the Head of the High Council of Justice.  That is why I am working with the members of the High Council of Justice, exactly for being engaged on these matters that are crucial for the Albanian citizens, but of course for all the matters Albania faces.
