But there are more narrow and practicable implications of fiduciary in terms of the operations of government. One does relate to the inherent right, or the rights issues, and that is because when those rights were entrenched in our Constitution they were not defined. So there is one aspect of the fiduciary relationship that is more defined as a duty, and it's been in a variety of court references--Sparrow and Delgamuukw, to give examples--that when government is potentially intruding on that right there is an obligation to consult. Then it goes on in terms of other obligations that may flow from this, and that's the issue of a potential intrusion, inadvertent or not, on an existing aboriginal right. But that's far away from this initiative because of its nature.

I have nothing against generally accepted accounting principles, because I am an accountant myself, but since political parties are really a special case and are not-for-profit organizations, I think there is a dangerous grey area here.

Now, about this matter of the majority, is 50% plus one enough? In my opinion, in theory, you can argue in favour of 50% plus one, but in fact, on such an important issue, that has such serious implications, not only for Canadians outside of Quebec, but also for the Quebec Canadians who don't wish to separate, it seems to me a distinctly insufficient majority which could actually fade away rapidly as a result of all the problems which would obviously arise once independence was declared.

I would like to add another point to the issue. We live in this bijural system in which the Supreme Court is called upon to make decisions, to decide arguments, some of which are conducted in French. The entire concept is debated in French in a legal system that is not necessarily a common law system, in a country where there has been a language debate for 40 years that has profound legal implications. So it's not through interpretation that we're necessarily going to understand all the aspects of the debate prior to a case being brought before the Supreme Court.

As for the Quebec City bridge, I am told that it would cost around $52 million just to finish painting it. There was an agreement between CN, the Quebec government and ourselves. Our contribution was approximately 10%. There are legal implications because there was a commitment from CN. I asked for legal advice in this regard, given that the initial evaluation, which had been done directly by CN, was for around $40 million, and that it is on the basis of that evaluation that there had been agreement between the three partners. In the end, the bridge was transferred to CN. It is no longer a Government of Canada bridge. I asked for legal advice on the matter.

I think the third important factor when looking at the process as such is to remember that the trade can't be separated from other issues and looked at in isolation. The WTO agreements deal with a lot of matters that traditionally states have seen to be matters that they can regulate domestically, on their own. On the other hand, the regulation of trade—and we're seeing this more clearly in the WTO—has implications for areas not dealt with directly in the WTO agreements—environmental regulation, human rights, and even potentially business ethics.

As the process has gone on, more and more it's becoming clear that tackling poverty has a strong economic dimension as well, or economic advantages. I think that's very much echoed by the OECD, of which, of course, Canada is a very distinguished member. In a recent meeting there of ministers of social affairs, the OECD Secretariat made a very strong statement in that regard when they said that not only does poverty have social justice implications, but it also has severe economic implications currently and into the future. I know that all the member states, all the countries represented there, had no difficulty in accepting that and endorsing it.
