As I read the analysis of the bill, an organization would not be subject to the bill unless it has made resources available to someone who is currently engaged in terrorist activities. It would seem a charity that supported a terrorist group and perpetuated terrorist acts, whatever definition you use, in the past, could still be registered if it is believed the same terrorist group may not be currently involved in terrorism.

On the question of the rule of law, again, I think the fundamental problem here is that NATO was acting within the provisions of the UN charter, but they chose not to use the appropriate article, article 51 on collective self-defence, because I genuinely believe the reason 19 NATO countries would agree to carry out this action was the fear of the war spilling over and becoming a regional threat in southern Europe, and that is a threat to NATO's interests, a collective security interest that is covered under article 51 of the UN charter. But because they relied on the humanitarian intervention, and it certainly suited our government to focus on the humanitarian intervention, because it supports the principle of a human security agenda that Minister Axworthy is very strongly supporting, I think that has put us in that problem of not being able to point to a legal justification for what we did. But I believe there was one.

Mrs. Legault and I agree. I don't think Quebec would be the model I would go to, unless you wanted to have the House of Commons added to schedule 1. That is, it would be subject to the act. This is not what we're discussing here today. If it is to look at parliamentary privilege information being disclosed by federal institutions as we know them now, I would not use this as a model. I'd rather look at what the U.K. and Australia and perhaps some other provinces have done.

He is very clear that water is in NAFTA, as are all the legal opinions that you will find from everybody on all sides of the border--and when I say “border” I mean the political border. We even met with lawyers from the Canadian government when the Liberals were in power, and they all said the same thing: water is in NAFTA. You don't see the word. You have to go to the old General Agreement on Tariffs and Trade to get the definition of a good, and there it is. It is in there as an investment.

The second challenge I would flag is addressing governance issues in the central Arctic Ocean beyond national jurisdiction. I think you're all aware of the “doughnut hole” and you've had other testimony on the central Arctic Ocean “doughnut hole” beyond national jurisdiction, an area of some 2.8 million square kilometres. As you've already heard, it's not a lawless area. You have the 1982 Law of the Sea Convention applying. It does provide freedoms of navigation, and freedom of fishing for other states like Japan, Korea, China, down the road if they so desire to exercise those freedoms, but of course they have responsibilities, such as to protect and preserve the marine environment, and to cooperate with other states in protecting the marine environment.

It has everything to do with what happens, I suppose, on the street versus behind the scenes, as noted in Ms. Bouchard's presentation, where it is produced domestically in clandestine laboratories. That's what this bill gets at, and I think it's very important to note that we are talking about and are trying to be specific about giving them, whether it be law enforcement or in terms of criminal charges, the ability to charge those issues.

Finally, we have the new Employment Equity Act. I shouldn't say it's new any more, because it was promulgated in 1996, but it's still a very...the implementation of it is starting now. Just to remind ourselves, it's to promote and facilitate compliance, educate and raise public awareness. The new powers under this legislation are that there will be, starting now in November, an audit made by the Human Rights Commission. This time the legislation is also covering the public service, which was not the case before.
