However, the viability of the traditional fleet has been consistently communicated as a key consideration in the development of the fishery as evidenced by two of the four principles included in the Minister's 1997 announcement identified below:

In the late 1990s, DFO's turbot fishing plan provided that 50% of any increase in the Sub-area 0 turbot quota go to Nunavut interests. Since then, there has been no increase in quota in Division 0B, however 100% of the increase in Division 0A has been allocated to Nunavut interests. As well, in terms of the allocation of quota for northern shrimp, 51% of the SFA-1 quota increase of 2003, and 67% of the quota increase for 2004 was allocated to Nunavut interests.

Through the establishment of Nunavut as a distinct Territory and the implementation of the Nunavut Land Claims Agreements, the federal government has made a commitment to sharing quota allocations in Nunavut's adjacent waters directly with Nunavut interests, through the NWMB. This level of commitment was strengthened with the federal government's acceptance of the recommendations of the Report of the Independent Panel on Access Criteria in November 2002. In total, of the 28,300 tonnes of Northern Shrimp allocated in SFA 0, 1, 2, and 3 today, Nunavut interests have a 38% share and these interests hold only a 34% share of the total P. borealis allocations and 52% of P. montagui.

If future quotas declined back down to the thresholds, then the sharing would end and the temporary entrants would leave the Fishery. The overall 1996 quota to all SFAs combined (37,600) is used as a threshold to determine sharing. Thus, a major decline in one or more SFAs could preclude further sharing in any SFA." The highlighted statement above indicates that a scenario could arise where a reduction in TAC from one or more SFAs is so significant that it causes the traditional fleet to risk falling below the 37,600 quota in aggregate before the thresholds at which remaining allocation holders in other SFAs would otherwise be removed. Although this scenario has not materialized, proactive clarification of how this scenario would impact stakeholders could be beneficial.
