Art. 52 EPC sets out in paragraph (2) (a)-(d) a non-exhaustive list of items which are not regarded as an invention. This includes "Discoveries, scientific theories and mathematical methods" in (a). These activities share the common feature that they do not aim at any direct technical result but are rather of an abstract and intellectual character (see T 338/00, T 22/85, OJ 1990, 12, T 854/90, OJ 1993, 669).

Insbesondere heißt es in der Entscheidung T 22/85 (ABl. 1990, 12) bezüglich der in Art. 52 (2) c) EPÜ 1973 genannten Gegenstände und Tätigkeiten, für die eine Patentierung ausgeschlossen ist: "Diese von der Patentierbarkeit ausgeschlossenen Gegenstände haben eines gemeinsam: Sie beziehen sich auf Tätigkeiten, die nicht auf ein unmittelbares technisches Ergebnis abzielen, sondern vielmehr abstrakter und geistiger Natur sind."

In T 854/90 (OJ 1993, 669) the board noted that the boards of appeal had already emphasised the necessity for claimed subject-matter or a claimed activity to have a technical character if it was to be considered as an invention within the meaning of Art. 52(1) EPC 1973. In particular, in decision T 22/85 (OJ 1990, 12), the board stated with reference to the excluded subject-matter and activities set out in Art. 52(2)(c) EPC 1973 that "Whatever their differences, these exclusions have in common that they refer to activities which do not aim at any direct technical result but are rather of an abstract and intellectual character".
