European expert, Mr. Kenny Wright, then revealed that IP is the foundation of the European Union's economy, so the protection of IPR is a priority for the European Union. According to a study published by the European Union Intellectual Property Office, in October 2016, 38% of all jobs in the EU and 42% of EU GDP are supplied by IPR intensive industries.
During the seminars, the participants discussed topics related to the basic principles of IP, national and international regulations, IPR enforcement best practice, the role of right holders and how AGEPI can assist the APCSP. An IT communication system that will be developed by the Project to facilitate information exchange between the IPR enforcement institutions in the Republic of Moldova (e-IPR system) and other support tools were also highlighted.

Dariusz Goszczynski, expert from IPR Project, Poland talked about general obligations regarding to the organisation of official controls, specific elements of control plans, requirements of EU regulations, examples of different organizational structure of control’s system and that is the labelling and scope of protection.
”For example, ”Feta” is a very often counterfeit cheese. According to the Greek Ministry of Agriculture, the global sales market for Feta cheese reaches 400-500 thousand tons, while Greece exported only 89 thousand tons in 2003. Traditionally similar products are created in Albania and Bulgaria. From October 14, 2002 the name "feta" is protected and reserved exclusively for cheeses originating in Greece (PDO)”, said the expert.

The objective of the seminars was to enhance the capacity of the ACPSP to enforce IPR, following the recent amendment to the Contravention Code (Article 408), which gives the ACPSP power to investigate trademark and geographical indication infringements.
The EU Project ” Support to Enforcement of the Intellectual Property Rights” in the Republic of Moldova is funded by the European Union and implemented by Consortium of Archidata LLC (Italy), European Profiles S.C. (Greece) and Business and Strategies in Europe (Belgium). The project has a duration of two years and ends in November 2018.

Between 29th January and 2nd February, experts of the EU project “Support to Enforcement of Intellectual Property Rights”, Monica Pop and Ion Tiganas met with the General Police Inspectorate and General Prosecutor’s Office to finalise the Intellectual Property Rights (IPR) Enforcement Guide for Police and Prosecutors.
The publication contains national legislation in the field of criminal enforcement of intellectual property rights, case studies and best practices on IPR enforcement, as well as measures to combat piracy and counterfeiting on the Internet. Thus, the guide will be a useful aide memoir and will clarify aspects relating to both criminalisation of infringements and special investigation techniques.

In order to improve the right holders’ activity, the coordination of the Observatory on Enforcement of IPR and the response of enforcement institutions to IPR infringements, the international experts came up with recommendations in this respect.
Phil Lewis currently works as a consultant for a right holder Trade Association “Anti-Counterfeiting Group”. He previously worked for the Intellectual Property Office in the United Kingdom and was responsible for establishing the IPR Crime Unit in the United Kingdom and subsequently the European Union’s Observatory on the Infringement of IPR.

In turn, Xavier Vermandele, Senior Legal Counsellor, Building Respect for IP Division, Global Issues Sector, WIPO, emphasized: “I want to thank AGEPI and the EU Project “Support to Enforcement of Intellectual Property Rights” in the Republic of Moldova for organizing this regional seminar, which aims to build respect for IPRs in the Republic of Moldova, as well as the representatives of the countries that are here.
Within two days, participants in the Regional Seminar will address topics related to international and European standards for the enforcement of intellectual property rights, border protection measures, enforcement of IPRs in the digital environment, support tools for an effective enforcement of IPRs, the role of the right holders and courts in the enforcement of IPRs, voluntary measures to fight counterfeiting and piracy, Bulgaria, Hungary, Latvia, Poland and Romania’s experiences on IP enforcement, awareness-raising as part of the Strategy to Build Respect for IP, etc.

The study focuses on the EU economy and considers IPR-intensive industries as either those that register more intellectual property rights per employee than other industries or those where the use of intellectual property rights is an intrinsic characteristic of the industry’s activity.
On 30 September this year, the European Commission issued a press release through which welcomed the publication of the Study “Intellectual Property Rights intensive industries: contribution to economic performance and employment in Europe”, which measures the importance of intellectual property rights in the EU economy. The study found that 39% of total economic activity in the EU (worth some €4.7 trillion annually ) is generated by Intellectual Property Rights-intensive industries, and approximately 26% of all employment in the EU (56 million jobs) is provided directly by these industries; while a further 9% of jobs in the EU stems indirectly from Intellectual Property Rights-intensive industries.

At the opening of the event, Lilia Bolocan, Director General of AGEPI specified that this meeting comes to confirm the good cooperation between the institutions responsible for the enforcement of intellectual property rights in the Republic of Moldova and to establish the opening of the public authorities to fight the phenomena of counterfeiting and piracy, as well as to ensure an efficient exchange of information between authorities responsible for monitoring IPR enforcement, for the preparation of reports, analytical and statistical studies in the field.
The participants in the meeting discussed about the action plan of the Observatory on the Enforcement of Intellectual Property Rights for 2018. Another topic on the agenda was the structure, format and content of the National Report on the Enforcement of Intellectual Property Rights in the Republic of Moldova. The participants also brought up for discussion the topic related to the new site of the Observatory, developed by AGEPI.

During the meeting, Deputy Prime Minister Octavian Calmic, presented the developments in the components pillar underpinning the creation of the Deep and Comprehensive Free Trade Area: the dynamics of foreign trade of the Republic of Moldova, with emphasis on trade developments with European partners, including recovery of export quotas/import, harmonization of national legislation with the acquis communautaire on IPR, public procurement, trade in services, quality infrastructure and market surveillance, etc.
In this context, the Minister of Economy emphasized that the European Union remains the main trading partner of Moldova, and approximately 1,250 national companies (up to 20% compared to 2013) recorded exports in the European community states for 673 tariff positions, which is cumulative to over 67% of all our country’s exporters.

In turn, Director General of Customs Service Vitalie Vrabie listed the measures applied by the customs authority to ensure the enforcement of intellectual property rights, while noting that, in order to make progress in the fight against traffic in counterfeit goods, not only good cooperation between the competent authorities is sufficient, but it is also necessary to increase the degree of involvement of the right holders, the economic and image interests of which are to be protected.

The Experts of the EU Project "Support to Enforcement of the Intellectual Property Rights” in the Republic of Moldova, in partnership with the State Agency on Intellectual Property (AGEPI), organized a series of seminars, between 22-25 May 2018, on the enforcement of intellectual property rights (IPR) for the Agency for Consumer Protection and Market Surveillance (APCSP).
At the opening ceremony, the General Director of AGEPI, Ms. Lilia Bolocan, stated that the training of APCSP specialists in the field of intellectual property (IP) is very important because it will lead to a better understanding of the value of IP to society.
