Ce ne sont là que quelques-unes des initiatives qui sont en cours afin de moderniser notre mode de fonctionnement et de surmonter les défis auxquels nous avons été confrontés ces dernières années. Il nous a fallu faire preuve d’innovation et être prêts à revoir nos façons de faire les choses.
These are just a few of the initiatives that are underway to modernize how we operate and address the challenges that we have faced, over the past few years. It required us to think outside the box and to be prepared to review existing ways of doing this. This is not a one-time exercise. In this ever changing world, we need to be prepared to challenge ourselves on an ongoing basis. The Tribunal is committed to promoting this change process at all levels of our organization. Our tradition and reputation of excellence depends on it.   I am confident that if we are successful in embracing a culture of change and continuing adjustment, it will bode well for the future of the trade remedy system in Canada.

Pour ce qui est des transactions en cause, l'appelant a vendu des articles de bijouterie. Le témoin de l'intimé a décrit de façon précise le mode d'exécution de sa vérification de même que les transactions en cause.
The Tribunal is of the view that the evidence in this case is clear. With respect to the transactions at issue, the appellant has sold articles of jewellery. The witness for the respondent has clearly demonstrated how he executed his audit and what transactions are at issue. With respect to these transactions, even Mr. Shwaid during cross-examination testified that the diamonds were mounted on the settings and that the appellant charged the cost of that work, plus an amount for profit, but that taxes, however, were only remitted on the cost of each component rather than on the sale price of the article of jewellery. Although the appellant may have been told by its customers to charge the loose diamonds and settings separately, this could not waive the appellant's liability under the Act. Paragraphs 23(11)(c) and 43(c) of the Act are identical and read as follows:

For sole-source contracts, a checklist is available (i.e. Sole-Source and Limited Tendering Certificate) but seldom used. Within contracting files, there is no recorded evidence of a justification for sole-sourcing of the selected contractor. On occasions, managers will request that a particular contractor be contracted and, it is noted, that there is a number of repeat contractors.

L’arrivée des nouveaux employés a insufflé à l’organisation de nouvelles idées et un nouveau mode de pensée. C’est là un défi en soi. Si nous voulons connaître la réussite, il faut que les cadres supérieurs du Secrétariat du TCCE et du Tribunal proprement dit accueillent l’élan vers le changement qu’apportent les nouveaux membres de notre équipe.
The arrival of new employees has infused the organization with some fresh ideas and new thinking. This creates a challenge in itself. In order to succeed, this impetus for change coming from our new team members must be embraced by the senior management at the CITT Secretariat and by the Tribunal itself. Furthermore, all of this must take place within the confines of a set of international rules governing our work and within the strict deadlines imposed on us by the applicable Canadian legislation. To date, this has enabled us to challenge internal conventions and experiment with new ways of operating. This has already delivered positive results. One of our challenges, however, will be to keep this culture of innovation alive as today’s new recruits mature and become more comfortable in their job. We simply do not have a choice, if we want to keep up with the “New Challenges for Trade Remedy Systems amid the Changing Global Trade Environment”.
