J'ajouterais que, bien que je sois préoccupé par le fait que des individus disposant de cartes d'accès à des zones réglementées ont été accusés d'actes criminels, à ma connaissance aucune personne disposant d'une autorisation de sécurité n'a sérieusement nui à l'aviation civile au Canada.

I would also add that although I'm concerned about the fact that individuals with restricted area passes have been charged with offences, I am not aware of anyone with a restricted area pass significantly interfering with civil aviation in Canada.

I believe that, in several instances, such passes were given to individuals working for private security agencies. It was noted that more than 5% of these individuals had ties with organized crime. What has been done to rectify this situation?

On top of CATSA's role of screening passengers and their belongings, CATSA also screens some 2,300 airport workers a day. These workers, who have access to restricted areas, are selected at random. Well before they are granted a restricted area pass by the airport authority, they must undergo a thorough background investigation before a security clearance is granted by Transport Canada.

A formula determines the funding of NAFO. I believe it's on the basis of three components. The first is that the coastal states, and as I had mentioned earlier there are four coastal states, pay the first 10%. Another 30% of the cost of NAFO is shared equally among all the members of the organization. The balance is then paid on the basis of the shares of fish landings by the members. Given the fact that Canada is a coastal state and has a significant amount of the share of landings of fish from the NAFO regulatory area, I think we pay on the order of about $640,000 of a total budget of about $1.5 million--something on that order. That is all consistent with a formula that has been a standing practice for NAFO.

Part 1 of the bill deals with the Aeronautics Act. It clarifies and updates the regulation-making authority, particularly with respect to screenings. These include providing for the establishment of restricted areas; requirements for people or goods to enter a restricted area; the training and qualifications of screeners; requirements for security clearances and how to obtain these; the implementation of safety management systems, including at the Canadian Air Transport Security Authority, otherwise known as CATSA; requirements for equipment and the testing of security systems and equipment. It provides for all of these things.

Some of the grounds for revocation or denial are that the individual has been convicted of an indictable offence or for trafficking in drugs, weapons, or people; a breach of the Official Secrets Act; an assessment that he's likely to be suborned or coerced; that he or she has used threats or has been found to have committed a serious violent act; that he or she is affiliated with groups or individuals—as, again, Monsieur LeCours talked about—such as terrorists and terrorist organizations, for example; and that he or she has a bad credit history. This is particularly important with respect to a job that gives rise to the person requiring a clearance and a restricted pass. If that person has a bad credit history and it's proposed that they take up a position of trust, this would be a grounds for revocation or denial.

Clause 2(2) amends the existing extremely broad definition of “Canadian aviation document” in section 3(1) of the Aeronautics Act to make it subject to proposed section 3(3) of the Act. The effect is to remove security clearances, restricted area passes issued at aerodromes operated by the Minister of Transport, and other Canadian aviation documents specified in an aviation security regulation, from the Civil Aviation Tribunal review process contained in sections 6.6 to 7.2 of the Act. The Tribunal was established in 1986 as a technical body to review regulatory enforcement decisions as well as decisions related to the technical qualifications of pilots, air traffic controllers, aircraft maintenance engineers and other aviation personnel and organizations. Transport Canada does not consider it appropriate that the Tribunal review departmental decisions related to security clearances, restricted area passes, and whether an individual constitutes a security risk and thus proposes this amendment.
