Concerns regarding the accuracy of voter lists and potential impersonation of voters de facto abroad underlie longstanding opposition and civil society calls to publish signed voter lists after election day. Publication of signed voters’ lists raises a number of concerns regarding privacy of information. The concerns expressed by civil society seem to have been at least partially addressed in the interim version of the draft code, through the possibility of accessing the list of voters who voted. Considering the importance of ensuring a balance between data protection and the secrecy of the vote on the one hand and stakeholders’ interest in consulting the signed voter lists on the other, it is recommended, as a confidence building measure, to allow meaningful consultation of signed voter lists by stakeholders under specific conditions.

The draft code envisages the introduction of new technologies in respect of voter registration and identification. It is welcome that voter registration and identification issues are addressed, but the proper implementation of new technologies has to be ensured. Particularly in light of the short time before the next elections and the need to build trust in the electoral process, it is recommended that a number of issues be thoroughly considered, including harmonising new provisions with existing data protection laws and standards, applying proper procedures for procurement, ensuring public testing and certification of the equipment, guaranteeing contingency planning, providing sufficient training for electoral staff, and ensuring effective awareness-raising among voters and political parties. A gradual approach to the introduction of such technologies through a series of pilots would be a measure to enhance confidence in the system and provide opportunities to address technical issues regarding effective implementation. Initial pilots could take place, for example, during the upcoming local elections.

This is uncontrollably wide authority granted to electoral commissions, which may be abused given Armenia’s practice, by removing undesirable observers from the polling stations through arbitrary decisions of the commissions to keep the voting process away from public oversight. It should also be noted that by the adopted version of the draft this authority of the commission shall be extended on mass media representatives as well. That is, mass media representative may be removed from the sitting of the commission, and from the polling station on the voting day, upon a decision adopted by 2/3 of the votes of attending members of the electoral commission in case they consider that the latter has violated the requirements of the Electoral Code.

7. The safeguards of legal protection of the observers when they are in the polling station have been largely weakened by the Draft. If according to the legal regulation in force the observer may be removed from the precinct only in case of arrest or detention, according to the draft the chairperson of the electoral commission may remove the observer from the sitting of the commission, and from the polling station on the voting day, upon a decision adopted by 2/3 of the votes of attending members of the electoral commission in case an observer supports a candidate, political party running in elections, violates the requirements of this Code (article 31, part 5).

The Draft Electoral Code of the Republic of Armenia was adopted by the National Assembly of Armenia in its third reading on May 25, 2016. Unfortunately, neither the proposals submitted by the political forces and civil society, nor the recommendations on 2012 parliamentary and 2013 presidential elections by OSCE/ODIHR Election Observation Mission and on 2015 referendum by Referendum Expert Team and considerable part of the recommendations put forward in the Preliminary Joint Opinion on the Draft Electoral Code of Venice Commission and OSCE/ODIHR were considered.

Particularly in light of the extensive changes to the electoral system, the draft code would benefit from simplifying and clarifying procedures for voting, counting and tabulation, as well as the determination of election results. This would also require extensive training for electoral staff and comprehensive voter education well in advance of elections to ensure better understanding of the process and enhanced public confidence.

Taking into account the most widespread types of election fraud registered during the elections in Armenia in the recent years (especially the Constitutional referendum), the lack of public confidence towards electoral processes, as well as the content of the Electoral Code submitted to the National Assembly, we, the undersigned organizations, consider that a real change in the quality of electoral processes can happen only in case the following crucial mechanisms (all the 5) are included (amended) in the Electoral Code:

The draft code establishes limitations and deadlines for the formation of coalitions after the first round of elections. These provisions unduly limit the possibility of building a political coalition as a means for ensuring the “stable majority” required by the Constitution. It is recommended to reconsider restrictions on the number of participants in a coalition and extend the time period for formation of coalitions after the first round.

Against the backdrop of the failure to consider numerous opinions on the improvement of electoral legislation, it is of particular concern introduction of artificial barriers and significant restrictions put on observers and mass media representatives as the main subjects who carry out public oversight on legitimacy of elections. The effectiveness of public oversight of electoral processes has been promptly increased recently, which was obvious during referendum of constitutional amendments in December 2015, when the observers and mass media representatives prevented and revealed more than thousands of electoral violations and fraud, and investigations are still carried out on nearly 70% of them.  Therefore, there is such an impression that the authors who drafted Electoral Code made every effort to minimize effective oversight of electoral processes and the opportunities to reveal electoral fraud. Անհրաժեշտ է անհապաղ վերացնել հանրային վերահսկողության սահմանափակումները, դիտորդների և ԶԼՄ-ների իրավունքները վերադարձնել առնվազն նախորդ ընտրական օրենսգրքի մակարդակի կարգավորումներին և պատշաճ կերպով կիրառել ԵԱՀԿ/ԺՄԻՀԳ հանձնարարականները՝ վերացնելով դիտորդների ստուգարքները և ընձեռելով դիտորդական կազմակերպություններին հնարավորություն բողոքարկելու օբյեկտիվ ընտրական իրավունքի խախտումները, իսկ շահագրգիռ անձանց տրամադրելով քվեարկության արդյունքները բողոքարկելու առավել ընդգրկուն երաշխիքներ:

The restrictions imposed on public oversight should be immediately lifted, the rights of observers and mass media representatives should be returned to the level of at least the regulations of the previous Electoral Code and recommendations of OSCE/ODIHR should be properly applied by eliminating mandatory tests to be passed by observers, giving opportunity to observation missions to appeal the violations of objective electoral rights and to grant interested persons more comprehensive safeguards to appeal election results.
