على جميع المشتبه بهم أو المتهمين الذين يتقدّمون بطلب للحصول على المعونة القضائية أن يزودوا المحكمة بمعلومات عن أصولهم المالية وعن الموارد المالية لأفراد أسرهم لإثبات عسرهم المادي. ويراجع رئيس القلم مواردهم، وأصولهم، ودخلهم التصرفي لتقييم قدرتهم على دفع تكاليف الدفاع. ثم يقرر رئيس القلم إما منح المعونة القضائية كاملةً أو جزء منها، أو رفض الطلب. وفي حال حصول مشتبه به أو متّهم على جزءٍ من المعونة القضائية، يُطلب إليه المساهمة في دفع تكاليف دفاعه على قدر إمكانياته. ولا يساهم المتهم في هذه التكاليف إلا في حالة الإدانة، غير أنّه يجوز تجميد أصول المتّهم حتّى نهاية إجراءات المحاكمة.

Le Greffier examine leurs moyens, ressources et revenus disponibles afin d'évaluer, sur cette base, leur capacité à prendre en charge le coût de leur défense. Le Greffier décide d'accorder l'aide juridictionnelle intégrale ou partielle, ou de rejeter la demande. Si un suspect ou un accusé reçoit l'aide juridictionnelle partielle, il sera tenu de contribuer au financement de sa défense, à hauteur de ses moyens tels qu'ils ont été estimés. Les mises à contribution ne sont possibles qu'en cas de déclaration de culpabilité, mais les avoirs d'un accusé peuvent être gelés jusqu'à la fin de la procédure.

Show textShow cached sourceOpen source URL	على جميع المشتبه بهم أو المتهمين الذين يتقدّمون بطلب للحصول على المعونة القضائية أن يزودوا المحكمة بمعلومات عن أصولهم المالية وعن الموارد المالية لأفراد أسرهم لإثبات عسرهم المادي. ويراجع رئيس القلم مواردهم، وأصولهم، ودخلهم التصرفي لتقييم قدرتهم على دفع تكاليف الدفاع. ثم يقرر رئيس القلم إما منح المعونة القضائية كاملةً أو جزء منها، أو رفض الطلب. وفي حال حصول مشتبه به أو متّهم على جزءٍ من المعونة القضائية، يُطلب إليه المساهمة في دفع تكاليف دفاعه على قدر إمكانياته. ولا يساهم المتهم في هذه التكاليف إلا في حالة الإدانة، غير أنّه يجوز تجميد أصول المتّهم حتّى نهاية إجراءات المحاكمة.

La plupart des instruments réglementaires fondamentaux sont désormais en place. Les juges ont toutefois modifié certains articles du Règlement de procédure et de preuve et d’autres documents essentiels afin de rationaliser les procédures applicables au niveau de la mise en état et du procès et de porter la transparence des activités judiciaires du Tribunal à un niveau encore jamais atteint par d’autres tribunaux pénaux internationaux (nouvel article 5 I)). De plus, le nouveau Règlement clarifie certains aspects de la procédure par défaut afin que toutes les parties concernées aient connaissance du calendrier prévu pour ce type de procès. D’autres modifications précisent que des cas d’entrave à la justice peuvent survenir à tout stade de la procédure, que certaines déclarations écrites de témoins qui, pour des raisons valables, ne peuvent venir déposer en personne au Tribunal sont recevables, et que les victimes peuvent solliciter des copies certifiées de jugements du Tribunal en vue de demander réparation devant les tribunaux nationaux.

On whether the Tribunal had investigated other accusations from Hizbullah on the issue of investigators and Tribunal members, he saw that "there is no reason for that (...)
