This project examines the provisions that protect undocumented and smuggled migrants under international human rights law, and suggests how they might be integrated in migration policies, alongside economic and law enforcement considerations. It takes account of the 2000 Convention to Combat Transnational Organized Crime and its Protocols on Trafficking and Smuggling, as well as the 1990 Convention to Protect the Rights of Migrant Workers and their Families. At a time when increasing numbers of people seek to leave their country for a wide variety of reasons, it is vital to assert the rights of those who are least protected. Trapped between smugglers who abuse them, employers who often exploit them and states which regard them as criminals (and a potential terrorist threat), smuggled people are among those most exposed to risk.
Este proyecto analiza las disposiciones del derecho internacional de los derechos humanos que protegen a los migrantes indocumentados y aquellos que han sido objeto de contrabando. El proyecto determina cómo estas disposiciones se pueden integrar en las políticas de migración junto con los aspectos económicos y los relacionados con la ejecución de la ley. Asimismo, el estudio toma en consideración la Convención contra la Delincuencia Organizada Transnacional del año 2000 y sus Protocolos sobre el tráfico y la trata de migrantes, así como la Convención de 1990 sobre la Protección de los Derechos de los Trabajadores Migratorios y de sus Familiares. En un momento en que un número cada vez mayor de personas tratan de abandonar su país de origen por varias razones, resulta de particular importancia determinar y afirmar los derechos de las personas que gozan de menor protección. Las personas que son víctimas de la trata se encuentran expuestas a graves riesgos al verse atrapadas por traficantes que abusan de ellas, por empleadores que a menudo los explotan, y por Estados que los consideran delincuentes (y una potencial amenaza terrorista).
