Le juge Lambert, quoique souscrivant aux motifs du juge Hutcheon, a néanmoins rédigé ses propres motifs.  À son avis, l'arrêt Guerin ne venait pas établir un nouveau redressement unique applicable à tous les cas de manquement à une obligation fiduciaire.  Dans l'arrêt Guerin, le redressement était lié au contrôle exercé par le fiduciaire sur la propriété et la nature des rapports fiduciaires était sui generis en raison de la nature exceptionnelle des rapports entre les parties.  Comme il ne s'agit en l'espèce ni de biens en fiducie ni d'une obligation fiduciaire, a conclu le juge Lambert, l'arrêt Guerin est inapplicable.
