Technically speaking, posted workers are persons, who, on behalf of their employer, work for a limited period in the territory of a EU Member State, which is not the state, where they usually work. Estimated 1.2 Million posted workers (less than 1 % of the EU population of working age) are currently employed in the EU. This option is mainly used by the construction sector (25 %), in particular by small and medium-sized companies. Until now, the 1996 Posting of Workers Directive regulated the social rights of posted workers, apart from being supposed to prevent social dumping, when companies use this freedom to provide services. However, due to the fact that time and again practical problems occurred when the Posting of Workers Directive was applied, the European Commission proposed in March 2012 an Enforcement Directive for the implementation, supervision and practical enforcement, in order to improve the 1996 Posting of Workers Directive and make its application easier. The negotiations for this Enforcement Directive to protect posted workers against exploitation have been going on for more than 18 months.

Technisch gesehen sind entsandte Arbeitskräfte Personen, die im Auftrag ihres Arbeitgebers ihre Beschäftigung für einen begrenzten Zeitraum auf dem Hoheitsgebiet eines EU-Mitgliedstaates ausüben, der nicht jener Staat ist, in dem sie für gewöhnlich arbeiten. In der EU gibt es geschätzte 1,2 Millionen entsandte Arbeitskräfte (weniger als 1 % der EU-Bevölkerung im erwerbsfähigen Alter). Am häufigsten genutzt wird die Möglichkeit der Entsendung in der Baubranche (25 %), vor allem von kleinen und mittleren Unternehmen. Bis dato regelte die Entsenderichtlinie aus dem Jahre 1996 die sozialen Rechte der entsandten Personen und sollte Sozialdumping verhindern, wenn Unternehmen diese Dienstleistungsfreiheit nutzen. Da es jedoch immer wieder zu praktischen Problemen bei der Anwendung der EntsendeRL kam, schlug die Europäische Kommission im März 2012 eine Durchsetzungsrichtlinie für die Umsetzung, die Überwachung und die praktische Durchsetzung vor, damit die Entsenderichtlinie von 1996 verbessert und erleichtert werde. Mehr als eineinhalb Jahre wurde nun über diese Durchsetzungsrichtlinie verhandelt, um die entsandten ArbeitnehmerInnen vor Ausbeutung zu schützen.

Mitgebracht hat sie der junge Düsseldorfer Künstler Michail Pirgelis, der an diesem Augustnachmittag testet, ob sich die Installation für die offizielle Wiedereröffnung des Künstlerhauses Anfang September eignen könnte. Pirgelis zählt wie die Malerinnen Barbara Kussinger und Silke Markefka und die Video- und Installationskünstlerin Andrea Faciu zu den diesjährigen Preisträgern der Villa Romana, die hier für rund zehn Monate leben und arbeiten. Schade eigentlich, dass der Künstler seinen Architektureingriff am Eröffnungsabend dann doch nicht zeigen will. Denn der Kontrast zwischen der hier herrschenden Toskana- Idylle und dem technoiden Fremdkörper könnte auf das Eindrücklichste den Umbruchprozess illustrieren, in dem sich das traditionsreiche Künstlerhaus an der Via Senese nahe der Porta Romana seit ein paar Monaten befindet.

We hope for this colonial hindrance to be over and give way to a territory integrated to Argentina ensuring the full federal autonomy established by the National Constitution. This autonomy will most likely preserve the English language along with the Spanish one (it will be a bilingual territory) and the cultural traditions of those who inhabit them today. In sight of the visit of Queen Elizabeth II in April to the Vatican we thought of expressing in an imaginary dialogue between Queen Elizabeth and Pope Francis that good will that the British and Argentinean people wish to share.

En ocasión de la visita que la Reina Isabel hará en abril al Vaticano se nos ocurrió plasmar en un diálogo imaginario de la Reina con el Papa Francisco esa buena voluntad que los pueblos inglés y argentino desean compartir.
