He went on to praise "the worldwide trend towards abolishing the death penalty" and encouraged "all countries to declare a moratorium which would at least be the first step towards its total abolition and, to put an immediate end to the execution of mentally handicapped people or minors at the moment of commiting the acts they have been charged with."

The information provided...during the course of the meeting was very general in nature and did not contain specific details that would enable a proper and thorough investigation. We recognize the sensitivities associated with providing concrete information of this kind; however, details such as time period and location would be very important to facilitate the investigation process.

(a) Deploring the fact that the Government passed Bill No. 65 so quickly and without consultation and considering that in the present case if upper and lower limits or a "budgetary package" had been established in consultation with the workers concerned and their organizations, the hesitation of the Government with regard to arbitration would have been reduced, even removed, the Committee requests the Government to explore this possibility in future, in consultation with the parties concerned, and to keep it informed in this respect.

I am afraid, however, that there is a real difference between suing and intending to sue a party. The amendment sought in this case would not merely involve the correction of a name; it would also substitute a party. As Russell, L.J. said in the Mitchell case, “The amendment sought involves the correction of the name of the Defendant, albeit that it is alleged and correctly so, that it also involves the substitution of the Irish company for the Leeds company.” (at p. 721) The person sought to be substituted in this case would be a person which, prior to the substitution, had had its alleged debt, arising out of the acts complained of, extinguished. If the Rules in question were applied in this case, there would be a consequent revival of the extinguished “debt”. This, in my view, would take the attempted application beyond the scope of the rule-making powers in respect of the regulation of practice and procedure delegated by section 46 of the Federal Court Act.

15. The case brought by the Complainant is aimed at causing the Commission to declare and consider that the facts hereunder imputed to the Djiboutian armed forces and certain other agencies of the State constitute a series of violations by the Respondent State of various provisions of the Charter. The alleged wrongful acts are: the perpetration of attacks against unarmed civilians who were no participants in the combats between the forces and the rebel movement Front pour la restauration de l'unité et de la démocratie (in particular, summary and arbitrary executions, acts of mass rape, forced displacement and regrouping) arrests and preventive detention for periods exceeding the legal limit, etc.
