infection at pre- and post-treatment should be assessed by two tests as discussed before. However, when an approved7 treatment is used, post-treatment evaluation of eradication may be performed with one test only, in particular the UBT which is carried out twice with a two month interval. Once eradication has been confirmed, only one UBT could be acceptable in the follow-up phase. The follow-up period should be long enough (6-12 months) to demonstrate continuous lack of symptoms.

The Philippines is signatory to the 1951 Geneva Convention on Refugees and is committed to offering protection to those on its territory who deserve it. Through its Department of Justice, the Government of the Philippines supports a process whereby refugees can acquire status within the country and eventually acquire citizenship. Therefore the UNHCR has advised that it would be contrary to their policy to refer anyone in the Philippines as they are eligible to apply for the protection of the Philippine authorities.

It would be a disservice to Canada's diversity to argue that a uniform set of values even exists, let alone determines foreign policy, except to say that we should encourage the acceptance of similar diversity abroad, which is not to say much beyond a rather conventional human rights agenda promoting democratization and toleration. That we need a pillarization, if I can use that phrase, to tell us this is quite embarrassing.

In T 501/92 (OJ 1996, 261), the board ruled that if a new ground for allowing the appeal based upon the facts set out in the file record was raised by an appellant for the first time as a new argument during oral proceedings from which the respondent was voluntarily absent, it would be contrary to Art. 113(1) EPC 1973 and contrary to the principles underlying G 4/92 to decide to allow the appeal on the basis of this new ground without first giving the respondent an opportunity to comment. In the case in point the appellant (opponent) submitted at the oral proceedings that the failure by the proprietor to file a formal request for maintenance of the European patent should lead automatically to revocation of the patent.

In Isnana v. Canada (Minister of Indian and Northern Affairs), 25 the Court went even further: "The Plaintiff asks for costs of this application. I have considered that even though this application has not succeeded, the root of the controversy is that the March 17 letter was worded in a way that misled the members of the Standing Buffalo Dakota Nation into believing that the Minister had or had exercised authority over the election for Chief. That misunderstanding may well have led to difficulties in the governance of Standing Buffalo Dakota Nation that could have been avoided. For that reason I consider it appropriate to order the costs of this application to be borne by the Minister." 26

The criteria for what constitutes free and fair elections are internationally agreed upon, and international observers are put in place to apply these criteria. Counsel for the appellant noted that the notice of appeal that is claimed to be statute barred by the respondent was in respect of the tariff classification confirmed by the Deputy Minister under section 63 of the Act. However, in the respondent's brief submitted for purposes of the hearing, the appellant was notified that the Deputy Minister had abandoned tariff item No. 9008.30.00 and now took the position that the goods should be classified under tariff item No. 8528.10.99. Counsel argued, therefore, that the appellant should have 90 days from notice of this new tariff classification to launch an appeal. As the respondent's brief was received in August 1992, the appellant was within the time to appeal. Counsel contended that it would be a breach of the rules of natural justice not to know the case that must be made and not to be given an opportunity to respond to the new classification.

the defendant argued that a breach of the criminal conspiracy provisions of the Act could not serve as the unlawful means in an unlawful means conspiracy claim because the Act is a complete code, eliminating any such cause of action. The Court disagreed. The Court noted that the Act did not initially include a provision like section 36. Nevertheless, the common law filled that void by allowing a breach of the statute to serve as the unlawful element in an unlawful means conspiracy tort. Given that the statutory remedy came after, when the Act was subsequently amended, “the correct analysis is whether Parliament intended to take away this established remedy with the enactment of the statutory cause of action.” The Court found there is nothing in section 36 (or the debates surrounding its enactment) that suggests it was Parliament’s intention to eliminate the use of a breach of the Act as the unlawful means in a conspiracy claim. Rather, it noted that it “would appear to be incongruous with the purpose of the Act, being the elimination of anti-competitive behaviour, that Parliament would eliminate a common law cause of action that serves to punish such behaviour.”
