[52] The respondent spent a considerable portion of its written argument trying to persuade this Court that the trial judge’s findings about the nature of the police conduct were unreasonable.  The respondent submits that the trial judge went too far in his criticism of the police.  More specifically, the respondent submits that it was unreasonable for the trial judge to conclude that the Charter violations committed by the police were flagrant without considering the dynamic and evolving nature of the situation.  It also submits that the trial judge erred in failing to conclude that the police were faced with a situation of urgency that required immediate action from the patrolling officers.  I would not accede to these attempts to reverse the trial judge’s findings of fact.  A trial judge’s findings of fact on a voir dire concerning the admissibility of evidence must be respected unless they are tainted by clear and determinative error.  The trial judge made clear findings that from virtually the moment that the police arrived at the appellant’s residence, they believed that she was a suspect; he concluded that the police knew that the person they were meeting was susceptible to being involved in the death of Mr. Hogue.  I also note that the trial judge made a clear finding that the officers were not exercising their investigative powers arising from the 9-1-1 call when they came to Ms. Côté’s house.  Rather, he found that their purpose was to conduct a criminal investigation by speaking with an obvious suspect.  The trial judge made these clear findings of fact based on his first-hand assessment of the officers’ credibility by observing their testimony in court.  There is no basis disclosed for interfering with the trial judge’s numerous conclusions with respect to the police conduct and I thus decline to interfere with his findings.

Ear rot (ER) in maize is a prevalent disease worldwide which reduces yield and grain quality. Grain moisture content (GM) is an important factor which impacts the fungal development of ER species. Our purpose was to identify the genomic regions of maize in the control of GM and ER resistance, and the correlations between two traits. A meta-analysis was carried out using 241 quantitative trait loci (QTL) from 29 studies to propose meta-QTL (MQTL) on a high-density genetic linkage map (IBM 2 neighbors 2008). For GM content, 44 MQTL were identified on all chromosomes except for chromosome 9, while 29 MQTL were found for ER resistance, mainly located on chromosomes 3, 6 and 7. Moreover, 14 overlapping domains for GM MQTL and ER MQTL were observed on chromosomes 2, 3, 6 and 7, mainly focused on five active regions (bins 2.08-2.09, 3.04, 3.06, 6.04-6.06 and 7.03-7.03). There were 13 genes in the overlapping domain which could be divided into five classes: stress-related gene, photosystem-related gene, architecture-related gene, dynamic-related gene and seminal-related gene. It was possibly that the five-class genes were simultaneously related with GM and ER.

Participants at a workshop organized in December 2008 by the PRI noted a number of challenges in setting and implementing a research agenda on sustainable development. One of the most important is Canada’s very nature, characterized by a federal system and strong regional differences. Then there is the complexity of sustainable development itself. Its intricate dynamics (complex concept, multiple stakeholders, cross-cutting implications, lack of public education, etc.) necessitate a detailed approach without losing sight of the bigger picture. Leadership is also a critical dimension. A number of participants emphasized that senior-level champions can have a powerful influence, but also that leadership can be exercised at all levels within an organization, and argued that those who are conscious of the need for change have a responsibility to initiate action within their own sphere of influence. Another challenge is horizontal co-ordination across the federal government: sustainable development is inherently horizontal in nature and requires cross-cutting approaches, but the government has historically had difficulty managing these. Related challenges identified by participants included the importance of ongoing communications and the need to improve performance in implementation.

The information available to support our analysis has grown considerably. This year’s report is based on data from the 25 EU Member States and Norway and, where available, from Bulgaria, Romania and Turkey. The soil organic carbon (SOC) associated with different soil fractions varies in the composition and dynamics. The present work is aimed to evaluate the potential of near infrared spectroscopy (NIRS) to predict SOC content in different soil fractions of black soils. SOC contents of 136 black soil samples in China were analyzed and the NIR spectra were collected using a VECTOR/22 (Fourier transform infrared spectroscopy). Partial least squares (PLS) regression with cross validation was used to develop calibrations between reference data and NIRS spectra (n=100) which were validated using an independent set of samples (n=/36). Predictions for water-sieved aggregate associated organic carbon were generally good with R2 (coefficient of determination) ranging from 0.69 to 0.82 and the RPD (residual prediction deviation) from 1.2 to 1.8. NIRS well predicted the SOC in <53 μm mineral fraction (R2=0.97, RPD=5.4), but the prediction for SOC in 250～2 000 μm or in 53～250 μm particulate matter fractions was poor. However, the prediction for the SOC in 53～2 000 μm fraction was good (R2=0.79, RPD=2.2). In addition, NIRS very well predicted the SOC in fine particle fraction (<20 μm) (R2=0.93, RPD=3.8). Accordingly, NIRS showed a good potential to predict SOC in some soil fractions and could reduce tedious laboratory analysis.

Identifying LIM Protein Functions in Plants: The actin cytoskeleton is a complex intracellular system of dynamic filaments supporting various biological processes in higher eukaryotes, including cell division, growth, contraction, motility and defence against pathogens. In humans, deregulation of its dynamics or organisation can have dramatic consequences on health, e.g. myopathies and cancers. The PMB unit aims to unravel the actin cytoskeleton functions and its regulation and focuses on evolutionary conserved actin regulatory proteins expected to participate in fundamental cellular actin-based processes. Comparative analyses should identify central actin regulators and uncover common pathways involved in actin cytoskeleton remodelling. By studying LIM proteins with dual cytoskeletal and nuclear functions, the unit addresses the emerging issue on cytoskeleton-nuclear cross-talks.

In the Carbon Budget Model of the Canadian forest Sector (CBM-CFS2), root biomass and dynamics are estimated using regression equations based on the literature. A recent analysis showed that some of these equations might overestimate belowground net primary production (NPPB). The objectives of this study were to update the compilation of root biomass and turnover data, to recalculate the regression equations and to evaluate the impact of the new equations on CBM-CFS2 estimates of net primary production (NPP) and net ecosystem production (NEP). We updated all equations based on 635 pairs of aboveground and belowground data compiled from published studies in the cold temperate and boreal forests. The new parameter for the equation to predict total root biomass for softwood species changed only slightly, but the changes for hardwood species were statistically significant. A new equation form, which improved the accuracy and biological interpretation, was used to predict fine root biomass as a proportion of total root biomass. The annual rate of fine root turnover was currently estimated to be 0.641 of fine root biomass. A comparison of NPP estimates from CBM-CFS2 with results from field measurements, empirical calculations and modeling indicated that the new root equations predicted reasonable NPPB values. The changes to the root equations had little effect on NE estimates.

During the coming months, ESA’s scientists will prepare for the release of their main contribution to the mission, the Huygens probe, which will be released on 25 December to enter the atmosphere of Titan on 14 January 2005. Built for ESA by an industrial team led by Alcatel Space, this 320 kilogram probe carries six science instruments to analyse and characterise the atmosphere and its dynamics during its descent. If the probe survives the impact on reaching the surface, it will also analyse the physical properties of its environment after landing.

This allowed a strengthening of existing ties and a re-affirmation of the principles of the policy implemented by NTN-SNR, to achieve growth in these countries: local partnerships, the development of services and the premium positioning of its products. NTN-SNR’s objective is to double its turnover in these areas within five years, aiming ultimately for an 11 market share.
