Das jedoch war ein Verstoß gegen das Handelsabkommen mit den USA und im Zuge des Mechanismus erhielt das klagende Abfallentsorgungsunternehmen eine Kompensationszahlung von 70 Mio. US-Dollar. Derartige Fälle wären dann in Zukunft auch zwischen den EU und den USA möglich. Statt unparteiischen Gerichten entscheiden dann InteressenvertreterInnen, zahlen muss der Staat beziehungsweise die Gesellschaft.
